These Terms & Conditions apply to retail purchases made through loveandcarry.eu.

By placing an order on our website, you agree to these Terms & Conditions.

1. Products and Orders

We make every reasonable effort to ensure that product descriptions, photographs, prices and availability shown on the website are accurate.

Product colours may vary slightly depending on your screen settings.

To place an order, select the products you wish to purchase, provide the required delivery and contact details and complete the checkout process.

After placing an order, you will receive an order confirmation by email. The sales contract is concluded when we confirm your order.

If an ordered product is unexpectedly unavailable, we will contact you and offer an alternative product, a later delivery or a refund.

2. Prices and Payment

All retail prices displayed on the website include VAT where applicable.

The total price of your order, including any applicable delivery charges, will be displayed before you complete your purchase.

Available payment methods are shown during checkout.

We may change our prices at any time. However, price changes will not affect orders that have already been confirmed, except in the case of an obvious pricing or technical error.

3. Delivery

We deliver to the countries available for selection during checkout.

Available delivery methods, estimated delivery times and delivery costs are displayed during checkout and/or on our Delivery & Payment page.

We aim to dispatch orders within the indicated timeframe. Delivery times are estimates and may be affected by circumstances outside our reasonable control.

The risk of loss or damage to the goods passes to you when you, or a person designated by you, receives the goods.

Please check your delivery details carefully. Additional delivery costs caused by an incorrect address or failure to collect a shipment may be charged to you where permitted by law.

4. Right of Withdrawal and Returns

If you are a consumer in the European Union, you normally have the right to withdraw from your online purchase within 14 days after receiving the goods, without giving any reason.

To exercise your right of withdrawal, please inform us by email at eu.retail@loveandcarry.com before the 14-day period expires.

After notifying us, you must return the goods within 14 days.

Unless we state otherwise, the direct cost of returning the goods is paid by the customer.

You may inspect the product as you would in a physical shop. You may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

We will refund the amount paid for the returned product together with the cost of our least expensive standard delivery option, where applicable.

The refund will normally be made using the same payment method used for the original purchase.

We may withhold the refund until we receive the returned goods or you provide evidence that they have been sent back, whichever occurs first.

Certain products may be excluded from the right of withdrawal where permitted by applicable law.

5. Faulty Products and Legal Guarantee

All products sold to consumers are covered by the statutory legal guarantee required by applicable EU and national consumer law.

As a minimum, consumers in the European Union are protected by a 2-year legal guarantee of conformity from the date the goods are received. Some EU countries may provide additional consumer rights or longer protection periods.

If a product is faulty, damaged or does not conform to the sales contract, please contact us at eu.retail@loveandcarry.com.

Depending on the circumstances and applicable law, you may be entitled to repair or replacement free of charge and, where appropriate, a price reduction or refund.

Any commercial warranty offered by Love & Carry or by the manufacturer is additional to, and does not limit, your statutory consumer rights.

6. Liability

We are responsible for supplying products in accordance with the sales contract and applicable consumer protection laws.

We are not responsible for delays or failure to perform our obligations caused by circumstances outside our reasonable control, including disruptions to transport, natural disasters, war, governmental restrictions or other force majeure events.

Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited.

7. Personal Data

Personal data provided when placing an order is processed in accordance with our Privacy & Cookie Policy and applicable data protection laws, including the GDPR.

8. Governing Law and Consumer Rights

These Terms & Conditions and contracts concluded through our website are governed by the laws of Poland.

However, if you are a consumer residing in another EU country, this choice of law does not deprive you of mandatory consumer protection rights granted to you under the laws applicable in your country of residence.

Any disputes will be handled by the competent courts in accordance with applicable consumer protection and jurisdiction rules.

Where applicable, consumers may also use available alternative dispute resolution procedures.

9. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your purchase is the version published on the website at the time your order is placed.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
